Council Passes Moratorium on Plumbing Fixture Retrofit on Sale Ordinance

The Albuquerque city council unanimously approved a moratorium on the plumbing fixture retrofit on sale ordinance (O-06-41) during the March 1, 2010 meeting. The resolution, proposed by Councilor Trudy Jones, (R-10-48) is retroactive to January 6, 2010 when the original legislation went into effect. According to Councilor Jones’ office, the moratorium will extend until, “the city council acts to amend the ordinance or January 2011, whichever comes first.” The councilor’s office says it will include GAAR leadership in the revision process. The resolution is now awaiting the Mayor’s signature. The ordinance is clear to say, “No purchaser of real property shall be found to have violated the Plumbing Fixture Retrofit on Sale Ordinance for failure to comply with the ordinance during the pendency of this resolution.”

Send a note to councilor Jones thanking her and letting her know we appreciate the fact that we will be able to discuss this bill with the City Council.
