Low Water Toilet Requirements

A new ordinance taking effect in the City of Albuquerque will require replacing toilets and other existing plumbing fixtures with low-flow water systems. The ordinance went into effect on January 6, 2010 applies to any structure built before 1994 and served by the Bernalillo County Water Authority under the jurisdiction of the City of Albuquerque.

This is a City of Albuquerque ordinance, does the city have jurisdiction over the Albuquerque/Bernalillo County Water Authority and the County of Bernalillo. Seems to me the City does not have a water system since they creaed the water authority.
Jurisdictional authority needs to be established.

The ordinance does indicate that it is the responsibility of the buyer to replace the fixtures. Perhaps GAAR can communicate this correction to the local media?

When looking at the ordinance it says buyers.. but the video, news media and the GARR president seem to say sellers... We need to find out which one of our clients will be responsible for every change of homes 16 years or older. The closing remark of ask your Realtor puts us in a spot to use the ordinance in my opinion. Sellers are already paying 6 % commission in a market when they want to negotiate everything. I believe that my position will be to bring the ordinance and show my clients that are buying what is their responsibility.

If you read the ordinance, paragraph 6-1-6-3 states "Except as otherwise provided herein, within 90 days following a change of ownership that occurs on or after January 1, 2010, the transferee of an existing building shall replace any existing plumbing fixtures with low water use plumbing fixtures."
"Transferee" is defined as the Buyer. I don't see where there is a requirement for the Seller to install the low flow fixtures prior to the sale contrary to what the post states.

Did I understand Mark Pando correctly? Did he tell the reporter that we have had plenty of time to react to this?
