Need More Time to Resolve a Violations Notification?

If you need more than 48 hours to address a violation, don’t worry—help is available! Just be sure to request an extension within 48 hours of receiving the notice. SWMLS Staff may grant reasonable time extensions when requested promptly. For full details, refer to Section 9.1.11 of the 2025 SWMLS Rules and Regulations.

What Should I Do If Internet Issues Prevent Me From Meeting Compliance Deadlines?

Act fast—notify your Qualifying Broker and SWMLS Staff right away by calling the Help Desk at (505) 843-8833. If you have limited internet access, you can also email our Compliance Team at compliance@swmls.com to request a grace period or extension within the 48-hour window. Be sure to fully document the issue to support your request.

What’s the Protocol When the Tax Estimator on the Assessor’s Website is Down?

Even if the site is down, a Tax Levy Disclosure must still be uploaded within 24 hours of listing entry. If you're unable to obtain the document, notify the SWMLS Compliance Team by emailing compliance@swmls.com to explain the situation.

How Do I Respond to an MLS Violation Notice Regarding Tax Levies?

According to Section 1.18.3 of the 2025 SWMLS Rules and Regulations, the County Assessor’s tax levy disclosure must be uploaded within 24 hours of entering a listing into the MLS. If you receive a violation notice, simply upload the required document and notify our Compliance Team at compliance@swmls.com.
If the seller has formally waived the disclosure, please email the signed waiver to resolve the violation.

How do I list a property in both residential and Farm & Ranch on the MLS?

A property can be listed under multiple property types, provided it meets the criteria for each category and is entered as a separate listing. However, once the property is sold, only one listing may be marked as closed. You must notify SWMLS Staff by emailing compliance@swmls.com so they can delete the other listing.

Who should I contact for urgent real estate licensing questions?

Licensing is handled by the New Mexico Real Estate Commission. You can call them at 505-476-4622 or visit their website at https://www.rld.nm.gov/boards-and-commissions/real-estate-commission.

How do I update my contact information in the system?

Updating your profile is easy and convenient! Log in to your member portal and click on the ‘My Account’ tab in the upper right-hand corner of the screen, then click on the pencil icon to the right of your photo.

What are the Minimum Listing Requirements to Avoid a Violations Notice?

Aside from the required fields within the ‘Add Listing’ section and minimum photo requirements, please be sure to upload the following documents within 24 hours of entering the listing into the MLS:

  • Tax Levy Disclosure – required on all listings unless the seller has expressly waived the disclosure.
  • Lead-Based Paint Disclosure - required on all listings built prior to 1978 unless expressly waived by the seller.

Pro Tip: Be sure to select the titles from the drop-down menu, otherwise, the automated system may flag them as missing even if they are uploaded and properly named.

What are the Minimum Photo Requirements to Avoid a Violations Notice?

At minimum, the following photos are required unless the property is tenant occupied, substandard, or expressly waived by the Seller(s). For more information on photo rules, see Section 1.20:

  • Living Room
  • Kitchen
  • All bathrooms (based on number)
  • Exterior Front
  • Exterior Back

How do I look up my license or NRDS number in the system?

You can access your license number and NRDS number from your Member Portal. Go to www.gaar.com and click ‘Login’ in the upper right-hand corner of the screen. Your license number will appear on the left-hand side of the dashboard under your profile picture, and your NRDS number will be located in the same section towards the bottom. Alternatively, you can check the NMREC’s license lookup at https://www.rld.nm.gov.

What’s the best way to get technical support for the real estate platform?

What do I do if a listing has missing or inaccurate information?

You may contact the listing broker or their QB directly to inform them, as they may not be aware of the issue. Otherwise, you can anonymously report the listing violation online by going to https://form.jotform.com/202116308294146.

What are the steps to follow when receiving compliance notices?

You must respond within 48 hours to avoid additional fines. If you have any questions or need any assistance, please call (505) 843-8833 or send an email to compliance@swmls.com.

What should I do if I receive a citation, but I disagree with it?

You can request a Compliance hearing for any violation citation you do not agree with by emailing the completed Request for Hearing to form to compliance@swmls.com. The Request is located on our Membership Forms page at https://www.gaar.com/membership/forms or by clicking here: https://www.gaar.com/docs/SWMLSHearingRequest.pdf

How can I get assistance with specific listing requirements?

What’s the process for requesting callbacks from support staff?

We have 3 easy ways to request a callback:

  • You can call our main number at (505) 842-1433,
  • Send an email to support@swmls.com, or
  • You can go request a call back from our Contact Us page at www.gaar.com/contact. Please enter your name and email, choose the appropriate department, and include a brief message and a reliable callback number in the message section.

What should I do if I experience technical difficulties managing a listing?

If you're having technical issues with managing a listing, please contact SWMLS staff as soon as possible. Whether you're reaching out via email (compliance@swmls.com or support@swmls.com) or leaving a voicemail at (505) 843-8833, be sure to include the following information, if available:

  • Your MLS ID
  • The property address
  • Screenshots or documentation of the issue
  • Any error messages received
  • A brief description of the problem

If the issue prevents you from meeting a listing deadline, you may request an extension. To be considered, you must notify us within 48 hours by emailing compliance@swmls.com.

May I delete photos or property information upon sale of the property?

No. Listing data, including photos, cannot be deleted from the MLS database by users. While a listing may be removed from the active display in the MLS compilation of current listings, all submitted data remains in the system for historical and other purposes approved by SWMLS.. 

However, the MLS does offer a “Hide Photos as Private” feature. This allows you to indicate that listing photos should not be displayed on public websites that receive SWMLS data. To use this feature, select all photos in the listing and apply the seller’s privacy preference for photo display..

What should I do if I notice a problem with a listing in the MLS that violates one of the MLS Rules?

To report a violation, you have several options:

  1. In Flexmls, on the listing page in the top right corner, there is a “Report Error” button. This is completely anonymous, and SWMLS staff cannot reply to the messages.
  2. Go to ZipForms | Greater Albuquerque Association of REALTORS® and click on “Report a Listing” under SWMLS Forms/Existing members.
  3. Contact the listing agent or their broker directly to inform them, as they may not be aware of the issue.
