SWMLS Rules Updates: August 2023

Richard Gibbens, SWMLS Executive Director reviews the August 2023 Rules Changes going into effect on September 18th, 2023.


No Offer Deadlines in Public Remarks

Language such as "Accepting offers until Sunday at noon" is now prohibited in Public Remarks. Please utilize LO/SO to communicate this message. This change was made because most consumers do not understand that a seller can accept an offer at any time and is not obligated to wait until the stated deadline.


Coming Soon Status

Previously, if a listing used Coming Soon and was Canceled or Expired, you could not use the Coming Soon status again for 90 days. This was changed to 30 days to align with rules regarding DOM and CDOM so a listing off the market for 30 days, completely resets as if it was a new listing.


Transferring Listings between Brokerages

Previously if a member changed brokerages, they would have to complete a form and have it signed by any current sellers to move the listing to the new brokerage. SWMLS has eliminated the form and now only requires permission from the releasing Qualifying Broker. As a reminder, all of the proper legal forms must still be completed to facilitate that transfer and is the responsibility of the Qualifying Broker to ensure its completion.


SWMLS Staff Changes on Listings

As a courtesy to members, if SWMLS Staff discovers obvious typos or issues with a listing in five specific areas, we will fix the issue proactively with notice to the Listing Broker. Those areas are:

  1.  Parcel ID is not in the correct format
  2.  Address is misspelled
  3.  Obvious Date Errors (Estimated Close Date of 09/31/21 entered on 09/01/22)
  4.  Incorrect Area (assuming pin location is verified as correct)
  5.  List price of $250k, noted as sold price of $2.5 million

In addition, with written permission from the Listing Broker, SWMLS Staff now has the option to  DELETE (rather than cancel) listings in multiple property types after the property has sold.


Sold Price on IDX Listings

This is simply a clean-up change to make the rules reflect that displaying the sales price is prohibited.
