O-25-88 Is Back on Wednesday, August 13th—We Need YOU to Show Up to the LUPZ Committee Meeting.
For the past two months, we’ve broken down Ordinance O-25-88—known as the “RENT” ordinance—into its most problematic parts. We’ve explained how it would impact housing providers, tenants, and the rental market in Albuquerque.
Now, it’s back.
O-25-88 is on the Land Use, Planning & Zoning (LUPZ) Committee agenda for Wednesday, August 13 at 5:00 PM, and we need REALTORS® to show up in force—either in person or via Zoom—to speak up against this deeply flawed proposal.
What We’ve Covered in the Series:
- Hands Off Our Leases: How O-25-88 micromanages private rental agreements and strips landlords of flexibility to create fair, workable leases.
- Repairs Gone Wrong: The dangers of allowing tenants to hire their own contractors and deduct rent, risking poor workmanship, inflated costs, and legal disputes.
- Public Records, Private Lives: Privacy concerns from a mandatory property registry that exposes landlord data to the public.
- Who’s in Charge? Due process concerns over enforcement powers concentrated in city staff, bypassing the courts.
- A Seat at the Table: The ordinance was crafted without input from housing providers, resulting in unbalanced policy.
- Pets, Deposits, and One-Size-Fits-All Rules: Restrictions on pet deposits and policies that ignore property-specific needs.
- Unprotected Tenants: The ban on requiring renters insurance, leaving both tenants and landlords vulnerable.
- Relocation Costs on You: Vague triggers and no cost cap on landlord-paid relocation expenses, even before due process.
Why This Matters Now
The LUPZ Committee voted down O-25-88 in June, but because it was never formally removed from the committee, it can—and will—return. This is our chance to stop it again and push for a better, more balanced approach to rental housing policy.
Your presence—whether in the Council Chambers or via Zoom—sends a clear message: REALTORS® and housing providers are engaged, informed, and ready to protect private property rights.
