OPPOSE Senate Bill 411

The New Mexico Association of REALTORS (NMAR) OPPOSE the changes to the Uniform Owner Resident Relations Act because this legislation would make affordable rentals less available by providing significant risks that will likely be passed onto tenants and/or may cause some landlords to sell their units:  
  • Section 11 creates an eviction moratorium; however, it does not contain any requirements that the tenant prove that they cannot pay rent.
  • Section 6 changes the Retaliation section to include actions that are within the property owners' rights, such as deciding not to renew a lease, as proof of retaliation. The section also makes common communication between landlords and tenants protected activity (for example, communication regarding the functioning of an appliance).
  • The entire bill includes significant deadline extensions (doubling current times) and would require landlords to obtain a judgement before a writ of restitution, making it become much more difficult to regain lawful possession of a landlord's property.

SB411 is scheduled for a hearing on Wednesday, March 1, 2023, at 1:30 PM in the Senate Health & Public Affairs Committee (SHPAC) or 1/2 hour after the Floor Session.
