
SWMLS Rule 1.18.3 requires that the County Assessor–provided Tax Levy Disclosure be uploaded to the MLS within 24 hours on all Residential and Residential Income listings, based on the current list price (unless the Seller has expressly directed otherwise in writing).
So what should you do if the Assessor’s site is temporarily unavailable?
If you are unable to obtain the Tax Levy Disclosure due to a system outage:
1. Immediately place a clear note in the LO/SO remarks stating:
- The County Assessor’s website is currently down
- You are actively attempting to obtain the Tax Levy Disclosure
- The document will be uploaded as soon as it becomes available
2. Continue checking the assessor’s site regularly. Before attempting again:
- Clear your browser cache and browsing data
- Refresh your session to ensure you are viewing current site data and not a stored error page
3. If you receive a Compliance Notification, respond to the email promptly. Additionally:
- Inform the Compliance Department that the Assessor’s site is down
- Confirm you are making a good faith effort to comply
- Upload the disclosure immediately once available
Why This Is Important
Communication is critical, a note in LO/SO remarks shows you are aware of your professional obligations. Prompt communication with Compliance demonstrates active engagement and intent to follow the Rules. Good faith efforts are always considered in enforcement procedures under Section 9 of the Rules and Regulations
