
NAR has released a second Quarter 2 update on its 2026-2028 Strategic Plan, highlighting progress on legal initiatives designed to protect REALTORS® and strengthen the industry.
The report outlines efforts to advance legal advocacy, defend the REALTOR® brand and trademark, provide guidance related to ongoing litigation, and collaborate with industry partners to achieve favorable legal outcomes. These updates reflect NAR's continued commitment to protecting members' businesses while reinforcing the value of REALTOR® membership

Legal Protection from Potential Copycat Lawsuits
- Secured a major strategic settlement in the Tuccori homebuyer commission case that, if approved, will provide broad legal protection from potential copycat lawsuits for members, associations, MLSs and eligible brokerages.
- The level of protection and release for the industry is broader than what has been secured in any previous NAR settlement, releasing millions of people and companies from potential legal liability.
- This settlement would preserve business stability for members because it’s independent from Sitzer-Burnett and doesn't require any further changes to agents’ business practices.
Dismissal of Lawsuits
- Strengthened NAR’s legal footing in MLS and association access cases, with courts dismissing half a dozen lawsuits in the past year that challenge NAR’s membership and MLS structure. The decisions reinforce that NAR’s policies are competitive, consumer-focused and applied fairly—and may help strengthen NAR’s position in similar pending cases.
- Strengthened litigation communication with REALTOR® association counsel. Quarterly webinars proactively share critical information about NAR litigation and create a more consistent channel for state and local association attorneys to exchange updates.
REALTOR® trademark
- Protected the REALTOR® trademark through systematic media monitoring and correction. NAR reviewed a high volume of national and local news coverage to assess whether outlets use the REALTOR® marks correctly. This work is showing results: More than 80% of needed corrections are being made, and fewer than 2% of reviewed articles require follow-up education on proper use.
- Launched a cross-departmental brand protection team to align how NAR safeguards the trademark, building awareness for proper brand use and gathering feedback to keep improving protection efforts.
- Expanded NAR’s ability to detect trademark misuse online by onboarding a brand protection vendor that uses digital technology, including AI, to assist in detecting unauthorized, non-member, third-party misuse of the REALTOR® trademarks. Together, these initiatives further reinforce our proactive approach to protecting the REALTOR® brand.
