SWMLS President Teri Hatcher shares important updates from the October Board of Directors meeting, focusing on MLS compliance, common violations, and how subscribers can avoid unnecessary fines.
Most Common Compliance Issue: Pending Listings Past Their Closing Date
One of the most frequent compliance violations involves pending listings that remain in the MLS beyond their estimated closing date.
It's important to remember that the closing date entered when a listing moves to Pending status is an estimate. If the transaction is delayed or the anticipated closing date changes, subscribers can update that information directly in the MLS.
Keeping these dates current helps maintain accurate listing information for everyone who relies on SWMLS data.
Compliance Monitoring & Fines
SWMLS has increased its compliance monitoring efforts to improve the accuracy and reliability of MLS information. As a result, the number of fines initially increased as more violations were identified.
However, consistent monitoring and enforcement are beginning to make a difference, with violations trending downward as subscribers become more familiar with the process and address issues promptly.
The goal of compliance is not to issue fines but to maintain accurate, dependable MLS data that benefits all subscribers.
How to Avoid Compliance Fines
The easiest way to avoid a fine is to address compliance notifications as soon as you receive them.
When SWMLS identifies an issue, subscribers are notified and given an opportunity to make the necessary corrections before a fine is assessed.
It's also important to understand that SWMLS staff do not have the authority to remove fines. Requests to review or appeal a fine must go through a review process involving a group of your industry peers.
By keeping listing information updated and responding promptly to compliance notices, subscribers can avoid unnecessary fines while contributing to the overall accuracy of SWMLS data.
Working Together for Better MLS Data
Accurate MLS information is essential to the services subscribers provide to their clients. SWMLS remains committed to consistent compliance practices, fair enforcement, and helping subscribers understand their responsibilities.
